"For the last decade, LightSquared has planned to deploy a terrestrial network, and worked with the GPS community to make sure its network would not interfere with GPS.

LIGHTSQUARED’S SERVICE HAS BEEN EXPECTED FOR ALMOST TEN YEARS

· In 2001, LightSquared proposed using satellite spectrum for a fully-capable ground network.  In 2002, after discussions with the GPS industry representatives, LightSquared agreed to curtail any portion of its signal that crossed into GPS frequencies.  This agreement imposed restrictions that were 1000 times stricter than what the FCC rules eventually required.

· In 2003, the FCC adopted initial rules allowing LightSquared’s ground network to operate near GPS.  These rules were adopted after a full review by DoD, FAA and all other interested government agencies.  As the FCC said recently, “extensive terrestrial operations have been anticipated in [LightSquared’s spectrum band] for at least 8 years.”  FCC MSS Flexibility Order, ¶ 27 (Apr. 6, 2011).

THE GPS INDUSTRY UNDERSTOOD THE SCOPE OF LIGHTSQUARED’S NETWORK

· The 2003 rules allowed LightSquared to deploy over 10,000 base stations.

· In 2003, the U.S. GPS Industry Council (“USGIC”) stated that the restrictions of the 2002 agreement were necessary to protect GPS against “[t]he increased user density from potentially millions of MSS mobile terminals operating in ATC mode . . . [and] potentially tens of thousands of ATC wireless base stations.” Reply Comments of USGIC, IB Docket No. 01-185, at 2 (Sept. 4, 2003) (emphasis added).

· In 2004, the USGIC supported the LightSquared application for authority to operate a ground network under the 2003 rules, stating that the 2002 agreement was “intended to protect GPS receivers and at the same time allow [LightSquared] to maximize the utility of its ATC [ground network] service to its users.”  Letter from USGIC to FCC (Mar. 24, 2004).

· In 2005, the FCC removed all limits on the number of base stations LightSquared could build and increased their permissible power to 1.6 kw, the level at which LightSquared now plans to operate.  Again, this decision was reviewed by all interested government agencies and was not challenged by USGIC.

· Beginning in 2006 and continuing to 2010, LightSquared disclosed its intent to build a wireless network using tens of thousands of base stations in its annual filings with the SEC.

THE GPS INDUSTRY KNEW ABOUT LIGHTSQUARED’S PLANNED POWER LEVELS AND DID NOT OBJECT

· In 2009, LightSquared asked the FCC to increase the power levels of its base stations by approximately 10 times to 15 kw, to match the power levels at which other wireless networks are permitted to operate.

· USGIC did not object to even those higher power levels.  It objected only to the possibility of interference into the GPS band from low-power indoor femtocells, an objection it withdrew in August 2009 after reaching agreement with LightSquared.

· In March 2010, the FCC approved LightSquared’s increased power levels.  As with all previous FCC proceedings, the order was issued after a public proceeding and was fully coordinated with all interested federal government agencies.  Neither GPSIC, nor any other party, filed for reconsideration or review of this order.

· Also in March 2010, the FCC required LightSquared to build a ground network reaching 260 million people by the end of 2015.  Neither GPSIC, nor any other party, filed for reconsideration or review of this requirement.

LIGHTSQUARED IS DOING EVERYTHING IT CAN TO WORK WITH GPS TO ADDRESS ISSUES RAISED ONLY A FEW MONTHS AGO

· In September 2010, USGIC raised for the first time — in a general mobile satellite proceeding -- the possibility that some GPS receivers may be subject to interference because they can be overpowered by signals transmitted by LightSquared inside the spectrum the FCC licensed to Lightsquared.

· In November 2010, LightSquared applied to allow devices onto its ground network that do not also communicate with its satellite.  This application did not change the power, number, deployment or any other technical characteristic of LightSquared’s base stations.  USGIC raised the same objection it raised in September.

· Although the interference issue was irrelevant to this application, LightSquared, in January 2010, proposed a rigorous program of testing to determine the extent of the susceptibility of GPS receivers to LightSquared’s transmissions, which the FCC made a condition of granting LightSquared’s application on Jan. 26, 2011.

· The FCC validated the GPS testing process a few weeks ago by unanimous Commission vote, noting USGIC’s September 2010 comments and the cooperative testing program, and stating that “responsibility for protecting services rests not only on new entrants but also on incumbent users themselves, who must use receivers that reasonably discriminate against reception of signals outside their allocated spectrum.”  FCC MSS Flexibility Order, ¶ 27 (Apr. 6, 2011).

Fails to let the Public know that the GPS Industry had 9 years to prepared for this major advancement in technology and the Department of Defense has known for 9 years and was SUPPOSED to prepare for this change.  Almost a decade of time given to change this and now the billions of dollars invested by Harbinger Capital Investors, Philip Falcone Lightsquared are seemingly supposed to be Collateral Damage because of the lack of oversight of the Department of Defense and the Department of Transportation even though they had 9 years of advanced noticed and signed off on this go ahead ?

Clearwire's Craig McCaw has his friends and previous employees on the band wagon to protect the interests of Clearwire and Craig McCaw is, in my opinion, calling in favors with the DOD, the DOT, and as many corporations as he can call in favors and rally in order STOP the FCC approval of Lightsquared and therefore KEEP Sprint in the Mix for Clearwire and avoid a takeover.  The Documents of Proof are obvious, however the public at large don't know this and they are rallying to Save Our GPS, the thing is they are targeting Lightsquared and demanding that their Senators and Congressman STOP Lightsquared when they should be demanding accountability with the DOD, the GPS Industry, the GPS Council, for not doing their part with 9 Years of advanced NOTICE.

The Letter above from Sam Graves and John Barrow talks of history of the GPS, as if the FCC does not know.  Thing is Sam Graves and John Barrow knows that the Department of Defense, the GPS Industry and others have known about this for 9 years so why is Sam Graves and John Barrow speaking out against Lightsquared?  Is Sam Graves and John Barrow connected to Clearwire, Craig McCaw or the Clearwire Cronies Clay Jones, Vance Coffman or James Kirkland?  What Motive does Sam Graves and John Barrow have in writing the above letter to the FCC ?

They act like they are concerned on Costs to GPS Users... this is a Flat Out Lie in Order to stir up the public and get support when in fact they are interested in protecting the GPS Companies, who would REALLY take the cost hit ... NOT the End User... and these Congress Members are Out to help Clearwire, Craig McCaw as well as to STOP fair competition to Clearwire, Verizon and AT&T (which is in part Craig McCaw, as Craig McCaw has a Large Stake in AT&T.

Do these Congressional Members have stocks involved, is there any political favors, any history or connections to anyone in the GPS Industry avoiding Millions in changes to their product, history or connections to Clearwire that NEEDS Lightsquared to be STOPPED to stay in business ??

Surely the Members of Congress Below know that the predecessors of Lightsquared, this same "GPS Issure" got the proverbial green light from the FCC in 2002, 2003, 2005 and 2010 with an Order from the FCC each time re-affirming the Go Ahead for Lightsquared ? The GPS Council, the Department of Defense, and others signed off each of those years that the FCC gave the Order.

If the Following Congress Members don't know then they SHOULD.  If they do know then what motivates them to protect Craig McCaw of Clearwire, and to Stand with the GPS Companies over fair competition and why do they speak out and jeapordize Billions of Investors money knowing that the documents exist to prove that the Go Ahead was given and the DOD, DOT and GPS industry knew for 9 Years.?

Do these Congress Members know that they are no financial liable for all this and they may face criminal charges at some point if it is proven that ANY of them acted in conspiracy to defraud shareholders or to defraud the Government?  Or to aid and abet crimes that violate Anti-Trust Laws?

Coalition to Save Our GPS - is the Coalition to Save Our GPS simply to save Billionaires Money and STOP Fair Competition ?

The Coalition to Save Our GPS sure did start a fast and furious "movement" in order to get people worked up and to get Congress, Senators, the FCC, the DOD, the DOT and more to rally behind them and to STOP Lightsquared.

Thing is Lightsquared has a NEW and Seemingly Better way.

The Lightsquared network will be "Terrestrial", another words there will be no dead spots in theory and add this to current possibly deals with Sprint that adds in Alcatel-Lucent Technology , the Cube Antenna and WOW, we may have the future of no Cell Towers and the Current Billionaires invested in Cell Tower... and well those Rallying Behind Clearwire, Craig McCaw don't want to lose their edge in the market place so they are creating a "circle the wagons" in order to get the FCC to STOP Lightsquared - TRUTH is Clearwire, Craig McCaw and his Cronies Clay Jones, Vance Coffman, James Kirkland and more are simply creating smoke and mirrors to stir up chaos to hold on to their own financial empire.

James Kirkland, General Counsel of Trimble Navigations is Sure after Shutting Down Lightsquared in Favor of Clearwire.

Clearwire, Craig McCaw is desperate for the FCC to STOP Lightsquared from Doing Business.

Clearwire, Craig McCaw seems to be getting James Kirkland, General Counsel of Trimble Navigations who used to be the General Counsel at Lightsquared, to Pull Favors, Manipulate Press, Rally the GPS industry and all to protect Clearwire, Craig McCaw.

Sprint owns a 54 percent stake in Clearwire and Sprint resells its mobile WiMAX service.

Clearwire Clearly needs Sprint, Sprint Does not NEED Clearwire, even though Clearwire Shareholders suggest that Clearwire is Sprint's only option.  That is not true, if Sprint had the financial backing Sprint could "take over" Clearwire.  And with Lightsquared as an Option for Sprint, then Sprint would have the money for a "take over" of Clearwire.  Craig McCaw is desperate to stay in business, it seems.  However maybe Craig McCaw will just partake in one of his famous bankruptcy's and let Clearwire fold and start a new company as his record seems to show.

Thing is Sprint does have another 4G offering and Clearly Karim Samii is Clueless.  Craig McCaw, desperate to stop the chatter of shareholders and keep up the facade is doing all he can to discredit Lightsquared so that Clearwire does not go Under.  The Truth is that SPRINT is Critical To Clearwire and not the other way around as Karim Samii suggests.  This is why Craig McCaw is circling the wagons per say and gathering all the cronies and connections he can to discredit Lightsquared.  This way, Craig McCaw can stay in business and be in a better positions.  Billions on Top of Billions MONTHLY are at stake here, and that is why Clearwire, Craig McCaws Good Ol' Boys such as Jim Kirkland - Trimble Navigations, Clay Jones and Vance D. Coffman of Deere and Company and others are rallying to support the cause of Saving Craig McCaws ass as there is a new game in own and Clearwire CLEARLY cannot compete, so its time for back alley deals, dirty tricks, political favors and calling in anyone who may be in a position to speak out against Lightsquared the the Public, the FCC, the DOT, the DOD ... may listen to. 

Clearwire Corporation, Craig McCaw is calling in Political Favors, Calling in Favors from Ex-Clearwire General Counsel, James Kirkland who is now the General Counsel at Trimble Navigations.  James Kirkland is quit outspoken against Lightsquared and the Reason is to protect Craig McCaw and Clearwire.

You read the Forums on Clearwire Stocks and see that Clearwire Shareholders are thankful to James Kirkland, see if James Kirkland, General Counsel of Trimble Navigations continues to stir up the GPS Industry and get groups rallied to pressure the FCC against Lightsquared, well then Clearwire won't be taken over Right?

Clearwire Shareholder says, "Thank God for Jim Kirkland"

James Kirkland seems to be making it his mission to stop Lightsquared no matter what.  Clearwire shareholders seem to believe that Lightsquared will not being doing business and that Clearwire will soon merge with Sprint.  James Kirkland says ""The way this process has worked...has been a combination of really really bad ideas and slightly less bad ideas,"   "thousands of manpower hours" from participating companies in the coalition have been poured into determining the feasibility of LightSquared's proposal. 


James Kirkland also called the FCC's extension-granting purely "procedural."

So does Jim Kirkland have an in with FCC?

How does Jim Kirkland, Trimble Navigations know this inside information, as if it to say don't worry Lightsquared won't be a viable option for Sprint.  All these smoke and mirrors to calm Clearwire Shareholders, when the Truth is that  Jim Kirkland, Trimble Navigations is misleading Clearwire Shareholders.

If James Kirkland is deliberately manipulating the press, pressuring the FCC and creating a GPS Industry Stir to affect stocks and keep Clearwire from a Take Over, well isn't this Illegal?  Does the SEC care about this?  James Kirkland's rant against Lightsquared is affecting the price of stocks and whether shareholders bail or not.


After all is said and done it will be easy to Prove that Craig McCaw is involved in a Conspiracy to Stop Lightsquared that seems to me to Violate Federal Anti-Trust Laws, the Sherman Act and more federal laws that SHOULD prevent this behavior.

 Add that to Misleading Clearwire shareholders as Jim Kirkland and Craig McCaw are doing and you have some nice White Collar Crimes going on ... IN MY OPINION.. (as, well I can Read)

The End User in the GPS Industry just wants their GPS to work, thing is its the GPS Industry's Problem and Expense.

The GPS Council is failing in letting consumers know that the GPS Industry had 9 years to fix this problem.  And now the GPS Industry is rallying the troops per say to STOP Lightsquared and cost them Billions so that those in the GPS industry do not have to bare the cost of fixing the problem on their end.

This Coalition to Save Our GPS is about saving the GPS Industry MONEY, and it is pressuring the FCC by sheer numbers and force in order to create a false media frenzy to STOP fair competition.

This Coalition to Save Our GPS is creating a Riot per say as they get GPS Consumers worked up, those who ride planes, drive cars, have boats and more all rallied by This Coalition to Save Our GPS in order to pressure the FCC to Stop Lightsquared from Fair Competition with AT&T, Verizon and with Clearwire who is really behind the GPS Riots with James Kirkland's Outspoken Lies in order to save the Financial Interests of Craig McCaw of Clearwire, add that to the agenda of the Deere and Company Board, and Favors at the Department of Defense seemingly pulled by Clay Jones, Rockwell and Vance Coffman - Ex- Lockheed Martin Big Wig.. and well what we have is lots of smoke and mirrors all to Accomplish... Saving GPS Companies Millions on Top of Millions in Change Overs and in Saving Clearwire from Take Over By Sprint, in my "Opinion".

Consumer Frustration is understandable but This Coalition to Save Our GPS is having you pointing you rage, frustration and proverbial fingers at the wrong "bad guy".   If you bought a GPS unit in the last 9 years, the Company should have told you or provided a trade in for an upgrade, and they did not so now they want act in conspiracy with Clearwire to STOP Lightsquared and protect all of their financial interest.

I get emails from GPS Consumers, I Know your frustration, thing is Philip Falcone, Lightsquared is NOT the Problem, the Makers of your GPS is the Problem, they knew.  Demand a Refund, or a Change... you cannot stop a much need competitor and upgrade in the Telecommunication Industry just to save money for major GPS Companies and Whiny Billionaire Craig McCaw of Clearwire ( Who is the REAL Puppeteer of the Fight against Lightsquared )

Truth is if and when Lightsquared gets going, Consumers will have more competitive prices in the Telecommunication Industry as a whole, GPS will be easier, cheaper and Better, Cell Phones and Internet will work EVERYWHERE, with NO Dead Spots and life will be better and cheaper for Consumers.... however the GPS Companies and Clearwire may lose Billions and WHO CARES really, It's how business works right.. Newer.. Better.. Faster.. more efficient and competitive rates is how business is suppose to work....
